If this can be proven, gaol time is warranted. My guess is that some super funds enter similar fee based arrangements with brokers and investment banks for their interest based investments. Why? Becasue the return to members for these investments has always been way below the 7% to (now) 12% returns such investments can deliver to other institutinal investors. (generally about 2-4% better than what you can get from a term deposit - depending on the risk). The members would do better put their money in a bank term deposit.
